Data Processing Agreement

This Data Processing Agreement forms part of the Terms of Service.
Roles
The Customer acts as the Data Controller.
The Company acts as the Data Processor.
Processing
The Company will process personal data only:
- on documented instructions from the Customer;
- to provide the Service;
- to comply with applicable law.
Confidentiality
Personnel with access to personal data are subject to confidentiality obligations.
Security
The Company will implement appropriate technical and organisational security measures including, where appropriate:
- encryption in transit;
- encrypted storage where reasonably practicable;
- access controls;
- logging;
- authentication;
- regular software updates.
Sub-processors
The Customer authorises the Company to use sub-processors.
A current list of sub-processors will be made available upon request or published on the Company’s website.
Personal Data Breaches
The Company will notify the Customer without undue delay after becoming aware of a confirmed personal data breach affecting Customer personal data.
Deletion
Upon termination, personal data may be deleted after the retention period stated in the Terms unless legally required otherwise.
